What are the grounds and residency requirements to file for an uncontested or "no-fault" divorce in Iowa?

Requirements to Use the Divorce with No Children

  1. You are married and want to file a petition for divorce.
  2. There are no minor children or adult children, and the wife is not pregnant.
  3. You, as petitioner, are not living in Iowa just to get a divorce AND either your spouse lives in Iowa or you have lived in Iowa for the last year.
  4. There is no existing "protective order" or "no contact order" between you and your spouse.
  5. I plan to file (or have already filed) financial statements containing full disclosure of all income and the identity and value of all assets and debts.

Requirements to Use the Divorce with Children

  1. You are married and want to file a petition for divorce, there remains no likelihood of conciliation, and the appointment of a conciliator will not preserve this marriage. -AND- The has not commenced a separate action for dissolution of marriage. -AND- This petition will be filed in good faith and for the purposes set forth herein.
  2. You, as petitioner, are not living in Iowa just to get a divorce AND either your spouse lives in Iowa or you have lived in Iowa for the last year.
  3. There is no existing "protective order" or "no contact order" between you and your spouse.
  4. The petitioner has not participated in any past or current litigation in Iowa or other state concerning custody of his/her minor children. -AND- Petitioner does not know of any persons not a party to these proceedings who has or claims to have physical custody of the minor children.
  5. Both parties have filed financial statements and both certify that the statements contain the full disclosure of all income and the identity and value of all assets and debts.
